About Lund Metcalfe

Services


Business Litigation

We define business litigation as any litigation matter where the dispute is centered around an economic relationship, not personal injury or bodily harm.  This includes disputes involving:

  • breach of contract;

  • corporate or partnership governance or dissolution;

  • director and officer liability;

  • theft of trade secrets;

  • violation of covenants not to compete and non-solicitation and non-disclosure agreements;

  • business torts;

  • fraud/misrepresentation;

  • breach of fiduciary duty; and

  • unfair competition.  

Our attorneys have significant experience representing clients across diverse industries including energy, internet service, telecommunications, manufacturing, pharmaceutical, construction, retail, real estate development, and professional services.    We have the skill and experience to guide our clients through litigation from beginning to end: from pre-litigation analysis and counseling through the filing of a complaint, motions practice, discovery, trial in front of jury, judge, or arbitration panel, and any subsequent appeal. 


Construction Litigation

We have significant experience with all aspects of construction litigation.  This includes payment disputes, change order disputes, delay claims, defective construction claims, and the filing and defense of mechanics’ lien claims.  Our attorneys have represented owners, general contractors, and specialty sub-contractors as lead and local counsel in construction matters throughout the region. 


Contract Review and Consulting

As litigators, we understand how contract drafting can shape the course of future litigation arising under the contract.  Just as importantly, properly crafted contractual language can materially affect whether a future dispute even leads to an actual lawsuit.  We work with our clients on the front end to draft effective contracts that will protect their interests in future disputes or that will help prevent future disputes from developing.  We regularly review both commercial and construction contracts for our clients.


Personal Injury/Property Damage Litigation

We represent clients in personal injury and property damage cases, including insurance defense claims.  Both Mr. Lund and Mr. Metcalfe have experience interacting with insurance carriers and representing clients in coordination with their insurance carriers. 



 

Our Attorneys

Michael A. Metcalfe

Mike Metcalfe is a litigator who, before forming Lund Metcalfe, practiced in some of Pittsburgh’s largest and most prestigious law firms, including Cohen & Grigsby and Leech, Tishman, Fuscaldo & Lampl, where he was named a partner in 2016.

Education

Mike graduated cum laude from Duquesne University in 2001 with dual majors in Philosophy and Psychology and received a Master of Arts in Philosophy from Villanova University in 2005.  In 2008, he earned his Juris Doctor summa cum laude from the Duquesne University School of Law, where he served as Editor-in-Chief of the Duquesne Law Review and won first place in the Carol Los Mansmann Appellate Advocacy competition.

Experience

Mike has successfully litigated cases in state and federal courts and arbitration tribunals throughout the United States, counseling and representing clients across a broad spectrum of industries including manufacturing, construction, telecommunications, professional services, energy, and real estate.  Mike’s clients have included both individuals and businesses ranging from closely held to publicly traded.  In addition to handling all varieties of business litigation, he has extensive experience in matters involving restrictive covenants; the protection of clients’ competitively sensitive information, trade secrets, and other intellectual property; breaches of contract; construction disputes; and various employment-related issues.

Mike has been named a Pennsylvania Super Lawyers Rising Star in 2015, 2016, and 2017 – a distinction awarded to only 2.5% of Pennsylvania attorneys.

Mike is admitted to practice before the Supreme Court of Pennsylvania and all Pennsylvania state courts and the United States District Court for the Western District of Pennsylvania.

Donald M. Lund

Don Lund has been a trial/litigation attorney for twenty-five years.  Before forming Lund Metcalfe, Don was the head of litigation and general counsel for Leech Tishman Fuscaldo & Lampl, one of the largest firms in the Pittsburgh region.  

Education

Don is a 1989 graduate of Yale University, where he was the varsity football captain his senior year.  Don graduated magna cum laude from the University of Pittsburgh School of Law in 1992, where he was a member of law review and received the Order of the Coif for academic excellence. 

Experience

For twenty-five years, Don has successfully tried and arbitrated cases in state and federal courts and arbitration tribunals throughout the country.  He began his legal career in 1992 and has worked for some of the most prestigious national and regional firms in Pittsburgh, including Jones Day and Cohen & Grigsby.  He has represented a range of clients in significant business and construction litigation matters, from Fortune 500 companies and prominent locally based entities to family trusts.  

Don regularly speaks and publishes on topics related to business litigation.   He developed and presented an entire program on Pennsylvania Injunction Practice and Procedure for the Pennsylvania Bar Institute in 2010.   His article “A Commercial Litigator’s Primer on Personal Jurisdiction in Pennsylvania” was published in the Pennsylvania Bar Association Quarterly. 

Don was named a Pennsylvania Super Lawyer for business litigation in 2015, 2016 and 2017.  

Don is admitted to practice before the Supreme Court of Pennsylvania and all Pennsylvania state courts, the United States District Court for the Western District of Pennsylvania, and the United States Court of Appeals for the Third Circuit.
